"I've been so discounted from day one. I have never been treated as a suspect, ever."
Daniel Horowitz, October 19, 2005

Should Daniel Horowitz have been "discounted from day one"?? What does this say about the police investigation?

The following sections will take a closer look at Dan Horowitz, along with his some of his statements, and a few impressions from various news sources.

The first officer to arrive on the scene after Daniel's 911 call was Sergeant Daniel Hoffman. A summation has been compiled from the preliminary hearing testimony of Sergeant Hoffman as to what was said to him by Daniel Horowitz, which follows:

Mr. Horowitz told me that his wife was inside the residence and that she had been murdered, he pointed to the smaller trailer-type residence that was closest to us. The first thing that he told me was that he was with a bunch of retired police officers that day. And my next question for him was -- was, "Are you a police officer?" And he told me no, that he was an attorney. I did notice that he had on a short-sleeved shirt, and on the front side of his shirt near the left shoulder it was wet. Looked like a clear type of liquid, but it was definitely wet. He had told me that he had knocked over the dog bowl, and he was responsible for having spilled the water near the entryway into the residence. He wanted to make sure that I was aware that the grocery bags were his, that he had brought those home. "Oh, oh, the grocery bags are mine. I dropped those. I can't believe this." My intention in speaking to him was to get Pamela Vitale's personal information so that we knew who the deceased victim was, and that's when Mr. Horowitz began speaking to me about who he believed might have been responsible. Initially he gave me Pamela's date of birth and her full name so I could have the spelling of it correctly, and then he went into about who he felt may be responsible for this crime. He told me that it was somebody that they had a history of problems with. He told me that Mr. Lynch was supposed to be coming by the residence to drop off a check, 188 dollars. He told me that he had touched the telephone to call 9-1-1, and that he had touched his wife's neck to see if she had a pulse. Those were the only things, at least to his recollection, that he did touch.

A few days later Dan gave his alibi to Dan Abrams on national TV.

HOROWITZ: I looked at her. I woke up earlier. Looked at her, just looked at her. She made my breakfast -- a little different -- I made my coffee and then went to breakfast with Bob Massi, instead of staying around the house because I had a breakfast meeting with him. We had a case together. And then I had a meeting on Polk with my team. Did that and then shopping, this and that and came home and she really shouldn't have even been home. She should have been at the ballet and then she was home. source
