Why would Jason Barnes, lead detective in the Pam Vitale homicide investigation, LIE in order to obtain a warrant to arrest Scott Dyleski?
On October 19,2005, Judge William M. Kolin issued a search warrant for the premises of 1050 Hunsacker Canyon Rd., Lafayette, CA. At that time, Scott Dyleski lived at that address with his mother and two other families. The warrant was issued based on the affidavit and statement of probable cause of Deputy Jason Barnes.
The LIE by Deputy Jason Barnes
In his affidavit of probable cause in support of the search warrant, Deputy Barnes wrote that at 5:53 p.m. on October 15, 2005, Daniel Horowitz called the police to report that his wife, Pamela Vitale, was dead at their home, 1901 Hunsacker Canyon Rd. in Lafayette. Sheriff's deputies responded to that location. Deputy Barnes went on to write that during the course of his investigation into Ms. Vitale's death, he interviewed Doug Schneider, of 2001 Hunsacker Canyon Rd. Deputy Barnes wrote that Mr. Schneider told him his wife (Karen Schneider) had been the victim of credit card fraud and added:
"Additionally, Mr. Schneider told me he had received a credit card statement which indicated the stolen credit card had recently been used to purchase hydroponic growing equipment which had been scheduled for shipping to 1901 Hunsacker Canyon, Lafayette California. Mr. Schneider believed this purchase which was to be delivered to 1901 Hunsacker Canyon may be related to the murder of Pamela Vitale."
At the conclusion of the Skelton hearing Deputy District Attorney William Clark argued that the connection between Scott Dyleski and Pamela Vitale was that the marijuana growing equipment was to be delivered to her house at 1901 Hunsacker Canyon Rd.
"As far as the 187, the homicide, the murder for Scott Dyleski, I think the connection between how this crime occurred in that items were to be delivered up there, that it is reasonable to presume that Scott went up there looking for these items to be delivered, that's the address that was put on there for them to be delivered, and came into a confrontation with Ms. Vitale at her residence there and assaulted her when she either confronted him about using the their address for this equipment or when he attempted to go inside the house to find if it was there."
The FACT is, Jason Barnes had the knowledge that NOTHING was to be delivered to Pamela Vitale's address at 1901 Hunsacker Canyon Road, and her address was never used for shipping purposes. It begs the question, why would the lead detective in the case lie to obtain a warrant?
Barnes- Police Report:
At 1515 hours, I received a second telephone call from Sheriffs Dispatch advising the neighbor, Doug Schneider, had called back and said his wife was upset and believed she would be the next victim of homicide. At 1520 hours, I called the number provided and spoke with a subject who identified himself as Doug Schneider. Mr. Schneider told me he had just returned home and had been informed by his wife that there had been incidents of unauthorized and fraudulent use of a credit card issued to his wife, Karen Schneider. Mr. Schneider told me his wife had received an E-mail from the company where the fraudulent purchases had been made. The E-mail indicated the purchase had been identified as fraudulent by the company and the order had been canceled. Mr. Schneider said the items which had been attempted to be purchased were electronic lights and other items used in the cultivation of marijuana. Mr. Schneider told me his concern stemmed from the fact that on the order information they received, it indicated the items had been purchased by his wife, Karen Schneider, with the Horowitz address. Per the order form, these items were to be delivered to Esther Fielding at 1050 Hunsacker Canyon. Mr. Schneider felt that his wife's name and credit card being associated with the Horowitz address and the recent murder of Pamela Vitale may be connected. I asked Mr. Schneider if he had provided the Lafayette Police Department with all information related to this fraudulent credit card use, including the E-mail attachments. Mr. Schneider told me he had and indicated he and his wife would be staying at an alternate location until he felt safe that the fraudulent credit card use was not associated with the homicide.
Why would any sane cop do what Jason Barnes did (blatantly lie to get a warrant)? And then have a swat style raid carried out on a 16 year old with no criminal history whatsoever?Especially knowing the person had an attorney for the cc fraud? To this day the Curiels are still pushing their civil rights violation case over how the cops stormed their home and drew guns to their heads.
That is not normal police behavior. Consider the case of Joe Lynch-- who DID have a very significant history including a RO in which Dan Horowitz claimed fear for Pamela, and also Jerry Wheeler -- the guy who owned the home where the only reliable scent dog (properly scented and at the right time) went, which was straight to his property, and then alerted-- There is also the fact that fresh tracks were seen along that same trail in the grassy mud. Wheeler also failed a polygraph. Yet neither Wheeler or Lynch had their homes raided swat style and lies told to obtain bogus arrest warrants. They were only questioned.
